Acceptable Behaviour Policy / Code of Conduct Lab Tots® Learning System Ltd

This document forms part of our safeguarding and child protection organisational policies, procedures, and standards.

The Lab Tots Learning System is committed to holding its educators to the highest ethical,intellectual & moral standards to provide a safe, exceptional resource for all learners.

This behaviour code outlines the conduct that Lab Totsä Learning System Ltd expects from all our staff, contributors, educators, and volunteers. This includes trustees, agency staff, interns, students on work placement and anyone who is undertaking duties for the organisation, whether paid or unpaid. The behaviour code is there to help us protect children and young people from abuse. It has been informed by the views of children and young people. Lab Tots Learning System is responsible for making sure everyone taking part on our platform, understand and agreed to follow the code of behaviour, and that they understand the consequences of inappropriate behaviour.

You should always follow this code of behaviour and never rely on your reputation or that of our organisation to protect you.

If you behave inappropriately, you will be subject to our disciplinary procedures. Depending on the seriousness of the situation, you might be asked to leave the Lab Tots Learning System. We might also make a report to statutory agencies such as the police and/or the local authority child protection services. If you become aware of any breaches of this code, you must report them to the Lab Tots Learning System via our complaints procedure.

Educators

Must confirm that the content and data entries added have been fully reviewed.

Must confirm that the content to be published has been fully checked and is:

• Factually accurate

• Contains NO inappropriate content, obscenities, expletives or profanities of ANY kin

• Complies with Child Protection & Safeguarding Policies

• Complies with & does not infringe any Data Protection, Copyright or Trademarking laws

• Complies with GDPR & Data Protection Laws

• Is all my own work and contains appropriate referencing

• Activities have been thoroughly risk assessed, with associated risk assessments, Material Data Safety Sheets, pertinent instructions attached to the course as additional documentation.

• Instructions have been provided to ensure a safe experience for all attendees

• Complies with Lab Totsä Learning System Ltd Terms & Conditions, Policies & Codes of Conduct

• You declare that any content, supporting documents or statements made or provided by me & the organisation I represent, are true and correct.

You agree that if any content you have uploaded is subsequently found to be intently incorrect, false, misleading, or contravenes any data privacy, copyright, trademarking laws, is found to contain inappropriate content, obscenities, expletives or profanities, fails to comply with Lab Totsä Learning System Ltd Policies, Terms & Conditions, Codes of Conduct, is found to be unsafe, you will lose your rights with Lab Totsä Learning System Ltd. Your profile will be terminated, and your content will be removed.

You agree that if any content you have uploaded is subsequently found to be intently incorrect, false, misleading, or contravenes any data privacy, copyright, trademarking laws, is found to contain inappropriate content, obscenities, expletives or profanities, fails to comply with Lab Totsä Learning System Ltd Policies, Terms & Conditions, Codes of Conduct, is found to be unsafe, you will lose your rights with Lab Totsä Learning System Ltd. Your profile will be terminated, and your content will be removed.

You are responsible for:

• prioritising the welfare of children and young people

• providing a safe environment for children and young people

o having good awareness of issues to do with safeguarding and child protection and taking action when appropriate.

• following our principles, policies and procedures

o including our policies and procedures for safeguarding and child protection, whistleblowing and online safety

• staying within the law at all times

• modelling good behaviour for children and young people to follow

• challenging all inappropriate behaviour and reporting any breaches of the behaviour code

• reporting all concerns about abusive behaviour, following our safeguarding and child protection procedures o this includes inappropriate behaviour displayed by an adult or child and directed at anybody of any age.

You should:

• treat children and young people fairly and without prejudice or discrimination

• understand that children and young people are individuals with individual needs

• respect differences in gender, sexual orientation, culture, race, ethnicity, disability, and religious belief systems, and appreciate that all participants bring something valuable and different to the group/organisation

• challenge discrimination and prejudice

• encourage young people and adults to speak out about attitudes or behaviour that makes them uncomfortable.

• promote relationships that are based on openness, honesty, trust and respect

• avoid showing favouritism

• be patient with others

• exercise caution when you are discussing sensitive issues with children or young people.

• ensure your contact with children and young people is appropriate and relevant to the nature of the activity you are involved in

• ensure that whenever possible, there is more than one adult present during activities with children and young people o if a situation arises where you are alone with a child or young person, ensure that you are within sight or can be heard by other adults

o if a child specifically asks for or needs some individual time with you, ensure other staff or volunteers know where you and the child are

• only provide personal care in an emergency and make sure there is more than one adult present if possible.

o unless it has been agreed that the provision of personal care is part of your role and you have been trained to do this safely.

When working with children and young people, you must NOT:

• allow concerns or allegations to go unreported

• take unnecessary risks

• smoke, consume alcohol or use illegal substances

• develop inappropriate relationships with children and young people

• make inappropriate promises to children and young people

• engage in behaviour that is in any way abusive

o including having any form of sexual contact with a child or young person

• let children and young people have your personal contact details (mobile number, email or postal address) or have direct contact with them via a personal social media account

• act in a way that can be perceived as threatening or intrusive

• patronise or belittle children and young people

• make sarcastic, insensitive, derogatory or sexually suggestive comments or gestures to or in front of children and young people.

You must abide by our Terms & Conditions.

• Support & promote the Lab Tots® Learning System

• Do not post / publish anything that could in anyway harm the reputation of yourself or the Lab Tots Learning System

• Network with & support fellow educators to develop the system

• DO NOT engage in defamatory actions against another educator – follow the appropriate complaints procedure.

Learners

Online

Lab Tots® Learning System Ltd Liability

In any event Lab Tots® Learning System Ltd shall not be liable for death or personal injury suffered by the client or session attendees arising out of the session, except in the event of Lab Totsä Learning System Ltd fraudulent representation or negligence. This limitation of liability shall also extend to any loss or damage sustained by property or belongings of the client, premises or any of the session attendees or for any further costs, demands or expenses incurred or suffered by the client, premises or session attendees arising out of the session.

Should Lab Tots® Learning System Ltd property or resources (physical or electronic) become damaged as a result of negligence, willful destruction, criminal damage on the part of the client or session attendees, they (the client / attendees) shall be deemed liable for full replacement costs of affected materials as well as any potential loss of revenue resulting from any current classes / workshops being affected and Lab Tots® not being able to replace said item in time. In such cases, Lab Tots® Learning System Ltd will issue an invoice for the monies and expenses ensued and will expect payment by the deadline issued on the invoice. Failure to comply, will result in legal action.

Your obligations to Lab Tots® Learning System Ltd are simply to co-operate with them fully, to provide any information required by them to enable them to run the session(s) properly and to follow all instructions provided during the sessions attended, especially relating to Health and Safety, Risk Assessments and any hands on experimentation instruction.

Nothing in these Terms and Conditions shall affect your statutory rights as a Consumer. All prices are as per the agreed order form, confirmation, registration form, invoice or written quote. Payment shall be in the manner specified in the order form, confirmation, registration form, invoice or written quote, by the date listed on said documentation. If payments are made after the date specified, a late payment charge will be liable as per the order form, confirmation, registration form, invoice or written quote. Any deposit paid by you, the client or session attendee, is non-refundable.
